How to Sell a Gun

The firearm sale process varies wildly by state. It generally involves the following:

• Price Out Gun – The condition of the firearm must be assessed and researched on online auctions to determine its value.
• Check State/Federal Laws – Sellers must look up state and federal laws to familiarize themselves with private sales (some states mandatre transfers through a dealer).
• Find Buyer – This involves advertising where permitted online and finding a buyer who is legally able to purchase a firearm.
• Check ID – Sellers should check the buyer’s age and residency. When applicable, they must ensure buyers have the required permitting.
• Perform Background Check (if required) – Always recommended, and sometimes legally required. Could be carried out through an FFL (with the completion of ATF Form 4473) or a state agency system.
• Document Transaction – Once paid, both parties should keep a receipt or a bill of sale to have proof that the firearm changed ownership.
